(AFP) - The retrial of Harvey Weinstein, whose prosecution and conviction for rape and sex assault ignited the "MeToo" movement, kicks off in New York on Tuesday.

The disgraced movie mogul's 2017 conviction by a jury was overturned seven years later by an appeals court that ruled the way witnesses were handled in the original trial was unlawful.

The voiding of the jury's verdict by the New York Court of Appeals was a setback to the movement against sexual violence and the promotion of justice for survivors.

Former Miramax studio boss Weinstein will be in the dock for the sexual assault of former production assistant Mimi Haleyi in 2006, the rape of aspiring actress Jessica Mann in 2013, and a new count for an alleged sexual assault in 2006 at a hotel in Manhattan.

The trial, expected to last up to six weeks in a Manhattan criminal court, begins Tuesday with jury selection, which could take five days, according to Judge Curtis Farber.

Weinstein, 73, hopes the case will be judged with "fresh eyes," more than seven years after investigations by the New York Times and the New Yorker led to his spectacular downfall and a global backlash against predatory abusers.

Weinstein is serving a 16-year prison sentence after being convicted on separate rape charges in California in 2023 for raping and assaulting a European actor a decade prior.

'Seeking justice'
The producer of a string of box office hits like "Sex, Lies and Videotape," "Pulp Fiction" and "Shakespeare in Love," Weinstein has appeared frail and gaunt at recent courtroom hearings ahead of the trial.

"It'll be very, very different because of the attitude of New York City, New York State and, I think, the overall country," said his lawyer Arthur Aidala.

"Five years ago, when you guys were here, there were protests. There were people chanting: 'Fry Harvey, he's a rapist'… I think that, overall, has died down," he said, adding that he hoped jurors would try the case on its merits.

Weinstein has never acknowledged any wrongdoing and has always maintained that the encounters were consensual.

Accusers describe the movie mogul as a predator who used his perch atop the cinema industry to pressure actresses and assistants for sexual favors, often in hotel rooms.

Since his downfall, Weinstein has been accused of harassment, sexual assault or rape by more than 80 women, including actors Angelina Jolie, Gwyneth Paltrow and Ashley Judd.

In 2020, a jury of New Yorkers found Weinstein guilty of two out of five charges - the sexual assault of Mimi Haleyi and the rape of Jessica Mann.

But the conviction and the 23-year prison sentence were overturned in April 2024.

In a hotly debated four-to-three decision, New York's appeals court ruled that jurors should not have heard testimonies of victims about sexual assaults for which Harvey Weinstein was not indicted.

"It really reflects the challenges that survivors face in seeking justice for sexual assault," said Laura Palumbo of the National Sexual Violence Resource Center.

The three survivors of Weinstein's alleged crimes are expected to testify once again.

New York (AFP) - Harvey Weinstein's lawyers asked Wednesday he be allowed to spend the night in the hospital during his retrial on rape charges, saying the movie mogul's health was deteriorating rapidly because of "mistreatment" in New York's notorious Rikers prison.

In papers filed with the court, a lawyer said 73-year-old Weinstein had received lacking care in prison while suffering from a number of "serious medical conditions," including leukemia, diabetes, thyroid problems, obesity, back pain, sciatica and other health woes.

"He is consistently mistreated for serious infections, medication is given incorrectly, or not at all, he is experiencing unhealthy and atypical weight gain, and he is forced to endure freezing temperatures while not even being provided clean clothing," said lawyer Imran Ansari.

All this justifies transferring Weinstein for observation to Bellevue Hospital where he has already been taken in recent months for urgent health care, the attorney said.

Weinstein is back in court because his 2020 conviction by a jury was overturned last year by an appeals court that ruled that the way witnesses were handled in the original New York trial was unlawful.

The voiding of the jury's verdict by the New York Court of Appeals was a setback to survivors of the #MeToo movement against sexual violence and the promotion of justice for them.

Looking feeble, Weinstein is attending the retrial from a wheelchair and his lawyers have complained repeatedly that in prison he does not get proper medical care.

April 21 (UPI) - Disgraced former Hollywood legend Harvey Weinstein will remain in Bellevue Hospital this week as his retrial gets underway and jury selection continued.

Last week, jury selection started for Weinstein's retrial over years-long sex crime allegations.

Weinstein, 73, was found guilty five years ago of third-degree rape that triggered the #MeToo movement and he was sentenced to 23 years in prison.

However, Weinstein's conviction was overturned last year by a New York appeals court, which paved the way for a new trial.

On Wednesday, the disgraced ex-Hollywood film producer had filed an emergency request to be transferred to Bellevue Hospital from Rikers Island due to a "tongue infection."

The former Miramax chief was among one of the most influential movie moguls. His career ended when several women accused him of using is status in Hollywood to coerce them into sexual encounters.

He was in Bellevue for a period in November and last spring during which it was later reported he received VIP treatment.

His request was granted this week where Weinstein will stay until Thursday when a hearing will determine if he will remain in Bellevue for the trial's duration.

Weinstein, who turned 73 on March 19, has argued that he may see "possibly death" if not permitted to leave Rikers, known for it's notorious and inefficient reputation with a proposed framework in place for Rikers to be placed in the hands of a receivership outside the control of Mayor Eric Adams' administration.

"He needs to do what he needs to do for himself," Elizabeth Glazer, founder of Vital City and ex-criminal justice adviser to former NYC Mayor Bill de Blasio, told The New York Times.

"(Weinstein) may be calling for the reform of the entire system, but his immediate purpose is relief for himself," added Glazer.

Harvey Weinstein Lawyer Says Ex-Model Used Hollywood Producer to Further Career, Using Trial to Stay in U.S.
NEW YORK (AP) - Harvey Weinstein 's lawyers sought Friday to raise doubts about an ex-model's allegation that he sexually assaulted her in her teens, portraying her as a wannabe actor who tried to leverage the former studio boss.

"You believed that if you had consensual sex with Mr. Weinstein, you'd get your foot in the door and become a movie star," defense lawyer Mike Cibella said.

"No, that's not what happened," Kaja Sokola responded. "I never had a consensual relation with Mr. Weinstein."

Throughout a day of questioning, Cibella sought to suggest that Sokola hadn't told the full story of her interactions with Weinstein. At one point, Cibella repeatedly asked whether she invited Weinstein up to a New York apartment - and into the bedroom - where she was staying in 2005. She denied it.

"I didn't want any shortcuts from Mr. Weinstein. I wanted him to be honest with me," Sokola testified at a later point, her voice growing heated.

She said the Oscar-winning producer promised to help her fulfill her acting ambitions but instead "broke my dreams, and he broke my self-esteem."

The Polish psychotherapist has accused Weinstein of repeatedly sexually abusing her when she was a teenage fashion model. Some of those allegations are beyond the legal time limit for criminal charges, but Weinstein faces a criminal sex act charge over Sokola's claim that he forced oral sex on her in 2006.

Prosecutors added the charge to the landmark #MeToo case last year, after an appeals court overturned Weinstein's 2020 conviction. The guilty verdict pertained to allegations from two other women, who also have testified or are expected at the retrial.

Weinstein, 73, has pleaded not guilty and denies ever sexually assaulting anyone.

The Polish-born Sokola, 39, had a jet-setting modeling career as a teen. She testified earlier this week that Weinstein exploited her youthful interest in an acting career to subject her to unwanted sexual advances, starting days after they met in 2002, while she was a 16-year-old on a modeling trip to New York.

She told jurors that four years later, when she was 19, Weinstein lured her to a hotel room by saying he had a script for her to see, then pinned her down on a bed and performed oral sex on her as she implored him not to.

Sokola never got a full-fledged role in a Weinstein movie, though he did arrange for her to be an extra in 2007's "The Nanny Diaries." Her scene ultimately got cut, she said.

His company also wrote her a recommendation letter to an acting school. She said she hadn't been able to afford it.

Sokola sued Weinstein several years ago over the alleged 2002 incident, and she ultimately received about $3.5 million in compensation. Her suits never mentioned the alleged 2006 assault. She testified Thursday that she'd had a tougher time coming to terms with it than she did with the alleged 2002 sex abuse.

Cibella underscored the omission, and he suggested that she sued to gain financial independence and be able to leave her now-estranged husband. On the contrary, she said, she was working two jobs and out-earning him.

Cibella also pointed to differences in some details of Sokola's testimony this week and what she told a grand jury last year, including the month of the alleged 2002 sexual abuse. The attorney further noted that Sokola is pursuing various legal pathways to stay in the U.S. long-term, and her involvement in the criminal case could help with one of them.

Sokola is expected to continue testifying next week.

The Associated Press generally does not name people who allege they have been sexually assaulted, but Sokola has given her permission to be identified.

June 3 (UPI) - Closing arguments got underway Tuesday after former movie mogul Harvey Weinstein's legal defense team rested in the retrial of his vacatedrape conviction in New York.

The retrial began six weeks ago with Weinstein, 73, charged with rape and sex crimes against three women accusers, who accused him of attacking them while in Manhattan between 2006 and 2013.

He had been convicted of rape and criminal sexual assault by a New York jury five years ago and was sentenced to 23 years in prison.

An appellate court overturned the conviction a year ago with a 4-3 ruling due to a trial judge improperly allowing "irrelevant" and "prejudicial" testimony and other evidence.

Manhattan District Attorney Alvin Bragg said his office would refile charges against Weinstein.

The current trial accuses Weinstein of two counts of first-degree criminal sexual act and one count of third-degree rape.

A jury of seven women and two men likely will begin deliberations by the end of the day on Tuesday.

Prosecutors have argued Weinstein used his position in Hollywood to control the three alleged victims, who were trying to find work in television and film.

His accusers are Miriam Haley, Jessica Mann and Kaja Sokola, who testified against Weinstein and said they were young and seeking careers in Hollywood with Weinstein's help.

Prosecutors brought 24 witnesses before the court to testify against Weinstein, whose legal team has argued his accusers engaged in consensual acts.

The witnesses included former assistants to Weinstein; relatives and friends of his accusers; and hotel workers at locations where he is accused of assaulting the alleged victims.

None of the witnesses who triggered the appellate court's ruling overturning Weinstein's conviction testified in the current trial.

Weinstein also did not testify in the current or prior trial. He has pleaded not guilty to all charges.

If found guilty on any of the charges, Weinstein likely will spend the rest of his life in prison.

Even if found innocent, Weinstein would remain imprisoned for his 2022 conviction on similar charges in a separate case in California. His legal team has appealed that conviction.

Weinstein's downfall significantly contributed to the rise of the #MeToo movement in 2017 after The New York Times and the New York Daily News reported details of the accusations against him.

Others formerly accused of sexual misconduct include actor Kevin Spacey, comedian Louis C.K., and former New York Gov. Andrew Cuomo.

Rapper and music mogul Sean "Diddy" Combs is being tried in federal court in Manhattan on similar charges.

He said it was not a question of whether his client engaged in sexual relations with the three women, but that those encounters were consensual.

He described the encounters as "transactional" and "casting couch" scenarios involving young women who used their beauty and charm to make an older man open doors for them.

Weinstein was the one they used, he argued, countering prosecutors who portrayed Weinstein as an all-powerful Hollywood figure.

Aidala loudly reeled off metaphors to explain his version of events, seeking to win over the jury with jokes.

He mimicked the victims to highlight inconsistencies, likening one of them to a child caught in a lie.

The veteran defense attorney stressed that victims continued to associate with Weinstein after the alleged assaults, something they did not dispute, explaining that they feared jeopardizing their careers.

During the trial, the three victims testified that their sexual encounters with Harvey Weinstein were not consensual.

The retrial also heard new evidence from Kaja Sokola, a Polish former model who testified that Weinstein first sexually assaulted her when she was a minor at age 16.

She said one occasion Weinstein pushed her onto a bed and forced her to have sex.

"I told him to stop," she said, "but he didn't listen."

Weinstein has appeared daily in a wheelchair, physically subdued, but laughing and joking with his legal team.

The New York jury deciding whether to convict disgraced film mogul Harvey Weinstein of sex crimes appears divided, with some jurors reportedly launching verbal attacks against each other and also considering information not brought up in the recent retrial.

Five male and seven female jurors have deliberated for three days over whether to find Weinstein guilty of rape and criminal sex acts. His 2020 conviction was thrown out last year.

Monday morning in court began with a note from the foreperson that read: "I need to talk to you about a situation which isn't very good."

Weinstein's lawyers then filed for a mistrial, which the judge denied, and details emerged about the unfolding drama.

After discussions with attorneys on Monday, Judge Curtis Farber later called the jury's foreperson back to the court's robing room to discuss the issue.

The foreperson told him that, even though juries are only supposed to consider evidence and testimony presented during the trial, some jurors were trying to convince others of their point of view by bringing up parts of Weinstein's public history, according to a court transcript.

"They are pushing people, talking about his past," the foreperson said.

Jurors were "not on the same page" and some were "attacking" others, trying to change their minds, the foreperson added, according to the transcript.

Judge Farber said he would give jurors a new instruction telling them that their deliberations relate only "to the three crimes".

"That is the only thing that it can be used for in their deliberations, only the evidence introduced at this trial," he told the attorneys, according to the transcript.

Weinstein was convicted of sex crimes in New York in 2020. The case was overturned last year when an appeals court found the 73-year-old did not receive a fair trial because a judge allowed testimony from women who made allegations against him beyond the charges at hand. Prosecutors then filed sexual assault charges again in September.

The appeals ruling hung over the retrial, making the court extremely cautious about allowing allegations against Weinstein from outside the realm of the case.

The drama comes after one juror told the judge last week that others had been speaking badly outside the courthouse about a fellow juror, and that they had "shunned" the person.

"It's playground stuff," he said.

The young man asked to be dismissed because he did not think deliberations were "fair and just", but the judge kept him on the jury.

The jury also sent a note Monday morning asking Judge Farber to reread the concept of reasonable doubt and rules of deliberation "especially in terms of avoiding a hung jury".

Typically in New York, if a jury in a criminal trial is not able to reach a unanimous verdict - as is required to convict or acquit the defendant - the judge may give them an Allen charge, an instruction to go back to deliberations to try once again to reach a verdict.

Eventually, a hung jury can result in a mistrial.

The jurors left at the end of Monday without a verdict, but sent a note saying they were "making progress", and requesting to revisit some evidence and be given "coffee for the morning for energy".

The trial centred on three women - a former television production assistant, an aspiring actress, and a model - who accused Weinstein of using his power in Hollywood to sexually abuse them.

In total, Weinstein has been accused of sexual misconduct, assault and rape by more than 100 women. While not all reports resulted in criminal charges, a separate sex crimes conviction for Weinstein in California means he is likely to spend the rest of his life in prison.

The decision by his accusers to come forward, and his subsequent conviction in New York, galvanised the #MeToo movement against sex abuse by powerful men.

New York Prosecutors to Retry Harvey Weinstein for Rape Following Conviction, Threats to Jury Foreperson
June 12 (UPI) - Former movie producer Harvey Weinstein won't serve time on a third-degree rape charge after a mistrial was declared on Thursday, but he likely could be tried again.

Manhattan Supreme Court Judge Curtis Farber ruled the jury could not reach a unanimous verdict on the rape charge and declared a mistrial, the reported.

The declaration means Weinstein could be tried again on the charge, but the jury's conviction on one count of sexual assault stands. Weinstein was acquitted on a second count of sexual assault.

He faces up to 25 years in prison, minus time already served, for the sexual assault conviction.

Weinstein, 73, also is slated to serve a 16-year sentence in California in a separate case that involved similar charges.

Thursday's court ruling came after jurors allegedly engaged in chaotic behavior during the prior five days of deliberations.

A jury foreman on Wednesday notified Farber of problems within the jury and on Thursday refused to continue deliberations due to alleged threats made against him by other jurors.

Farber asked the jury foreman if he would be willing to continue deliberations, but said he would not.

Farber also asked other jurors about their willingness to continue deliberations on the rape charge.

"They were extremely disappointed that deliberations ended before the reached a verdict," Farber told the court.

The jurors also were uncertain why the foreman claimed he had been threatened.

"They all thought they were involved in a normal discourse," Farber said.

The jury of seven women and five men on Wednesday found Weinstein guilty of sexually assaulting Miriam Haley but acquitted him on a similar charge involving accuser Kaja Sokola.

Manhattan District Attorney Alvin Bragg said his office will try Weinstein again on the rape accusation lodged by Jessica Mann, who said the Miramax co-founder raped her in 2013.

Accusers Haley and Sokola said Weinstein orally raped them on separate occasions in 2006.

Weinstein has maintained his innocence and says the acts were consensual.

Given the alleged issues with the jury, Weinstein's legal team on Wednesday asked for a mistrial and accused a juror of "menacing and harassment" of the jury foreman.

A Manhattan jury in 2020 found Weinstein guilty in the matter.

An appellate court last year vacated the verdicts after ruling the trial court judge allowed prejudicial testimony that was unrelated to the charges against Weinstein.
